Wills

 

What is a will?  A will is a legal document in which you set out the rights and responsibilities of others for your property and minor children and/or disabled dependents in the event of your death.

 

A "Pour-Over" Will is a type of will drafted in conjunction with the creatin of a trust.  This type of will is used to transfer, or pour, property into a trust after death.  This is helpful to transfer property that should have been placed into a trust, but was inadvertently left out of the trust.

Trusts

 

What is a trust?  A trust is a legal enitity that helps to avoid probate.  This is done by transfering ownership of your assets to a trust.  

 

There are two main types of trusts:  a revocable (also called "Living") trust and irrevocable trusts.

Powers of Attorney

 

A power of attorney allows you to name a person, called an agent, who can act for you in certain circumstances.  Powers of attorney are called durable powers because they remain in effect until you revoke or cancel them.  There are two primary tyepes of durable powers of attorney.
